There are two benefits, and almost everyone mixes them up. The flat-rate maternity rest allowance follows the birth and stays yours whatever happens. The daily benefits follow the interruption, and below eight weeks they are not reduced: they are not paid at all.

Two benefits with different rules

One follows the birth, the other follows the stoppage

The flat-rate maternity rest allowance goes with the birth: it equals the monthly social security ceiling, €4,005 in 2026, is paid in two halves, and depends on neither the length of your break nor your turnover. The daily benefits compensate a real interruption: €65.84 a day in 2026, provided you stop all activity. The two have different conditions: you can receive the allowance without qualifying for the daily benefits.

Six months of registration, not twelve

Maternity and paternity benefits for a self-employed worker require six months of registration by the expected date of birth, or when the leave starts. The twelve continuous months you read everywhere are those of sick leave daily benefits, a different entitlement. Mixing the two up leads women who are entitled to everything to give up. One more thing that counts: the right opens on contributions actually paid, not merely owed. Someone behind on contributions therefore opens no rights, whatever their turnover.

The eight-week cliff

To receive maternity daily benefits, you must stop all activity for at least eight weeks, six of them after the birth. Below that, you lose all of the benefits:

  • At 55 days off, the daily benefits are worth zero.
  • At 56 days, they are worth everything the length of the break opens.
  • The maternity rest allowance stays yours in both cases: it follows the birth.

Stopping does not pause the business

Your obligations carry on during the leave. The turnover declaration is still due at every deadline, at zero if need be. The business property tax stays due for the whole year: the reduction for remaining months applies to closures, not to pauses. And if you have just started, the ACRE relief is used up even with no turnover: a parent who starts just before the birth and stops straight away burns the exemption on an empty period, and waits three years to qualify again.

Amounts recorded on 8 September 2026 from ameli.fr and service-public.gouv.fr. They recompute from the annual social security ceiling: 48,060 divided by 12 for the allowance, by 730 for the daily benefit. A value that no longer fell out cleanly would signal a changed ceiling.

A worked example

Maëlle nearly stopped for six weeks

  1. Maëlle, a freelance graphic designer, is due in mid-November. Her average annual income over the last three years is €24,000.

  2. She is thinking of six weeks off so as not to lose her two regular clients, that is 42 days.

  3. At 42 days the daily benefits are worth zero: the minimum is 56, of which 42 after the birth. She would receive only the allowance, €4,005.

  4. By taking the full 112 days, she receives the same allowance plus €7,374.08 in benefits, that is €11,379.08.

Between six weeks off and the full leave, the gap is over seven thousand euros.

Before setting your dates

  • Check you will have six months of registration by the expected date. Without them, you are entitled to nothing.

  • Settle your URSSAF instalments before filing, not after.

  • Plan at least 56 days off, 42 of them after the birth, if you want the daily benefits.

  • Up to three weeks of antenatal leave can move to the postnatal period, on a doctor's prescription, requested the day before at the latest.

During the leave

  • File your turnover declaration at every deadline, at zero if need be. It never pauses.

  • Take on no work. The benefits compensate an actual interruption, and working a little puts them back in question.

  • The business property tax stays due for the whole year, it is not pro-rated.

  • What social security pays is flat-rate. If your standard of living needs more, only private cover taken out beforehand closes the gap.

Your questions answered

Can I work a little during my maternity leave?

Taking on work during maternity leave puts the payment of daily benefits back in question, since they compensate an actual interruption of activity. The flat-rate maternity rest allowance follows another logic, since it is tied to the birth and not to your break.

What happens if I stop for less than eight weeks?

A self-employed mother who stops for less than eight weeks receives no daily benefit at all. It is not pro-rated: the threshold is 56 days, 42 of them after the birth, and below it the payment is nil. The flat-rate maternity rest allowance stays yours in full, because it goes with the birth.

Do the amounts rise with my turnover?

A self-employed worker's maternity and paternity benefits do not rise with turnover: they are flat-rate. The allowance equals the monthly social security ceiling and the daily benefit that same annual ceiling divided by 730, whatever your income. The only variation is downwards: below €4,582 of average annual income over the last three years, everything drops to a tenth.

How long is a self-employed worker's paternity leave?

A self-employed worker's paternity leave lasts twenty-five days at most, thirty-two for multiple births, to be taken within the six months following the birth. It carries no flat-rate allowance: it rests on daily benefits alone. How it may be split, on the other hand, does not read the same way across official sources: ask the health insurance for your rules before setting your dates.

Is there leave on top of maternity or paternity leave?

Since 1 July 2026, supplementary birth leave comes on top of maternity or paternity leave. Each parent of a child born or adopted since 1 January 2026 can take one or two more months, provided they suspend their activity and have six months of membership on the first day of that leave. A self-employed worker receives €46.09 gross a day in the first month, then €39.50 in the second, and €6.58 for both months below the income floor. It is taken within the nine months following the birth.

Does the ACRE relief reduce my benefits?

The ACRE relief does not reduce maternity or paternity benefits: the exemption applies to what you pay, not to what you receive. It does have an expensive indirect effect: it is used up even with no turnover. Starting a business just before a birth and then stopping straight away burns the exemption on an empty period, and you have to wait three years to qualify again.
